Our Position on Toilet Provision Following the UK Supreme Court Ruling

At Healthmatic, we are committed to designing and delivering public toilet facilities that are safe, inclusive, and legally compliant.

Following the recent UK Supreme Court ruling, as highlighted by the Equality and Human Rights Commission (EHRC), we support and continue to provide a range of toilet options that ensure dignity and privacy for all users:

  • Single-sex facilities (e.g., traditional Ladies, Gents, and accessible Disabled toilets) remain a valid and essential choice. These offer clearly defined, safe spaces for users based on biological sex or need.
  • Separate unisex toilets—individual, self-contained cubicles with floor-to-ceiling enclosures—are equally supported. These provide privacy and safety while being inclusive for all genders.
  • However, mixed-gender shared spaces with communal areas—such as open-plan layouts with shared lobbies or washbasins—are not appropriate in public settings, particularly for council-run or high-traffic environments. These designs do not offer sufficient privacy or reassurance to many users and may fall short of the expectations now clarified in law.
